When can I get my gc based on these uscis data for sept 2005 eb-2.Please suggest me.
100% by this time next year if the spill over rules are not changed. If they are changed then in next 5 years.
(India upto september 2005 got almost 15K) per year india got 3500, do the math.

I am expecting a quick forward movement in the EB2 India/China category in the next year bulletins.
We have found out that we have about 10 times increase in EB2 India visa numbers from our calculations. I doubt it whether any attorney had any idea better than us, about the numbers we are getting for EB2 India/China from horizontal spill overs. In Ron's post he is no where mntioned any numbers other than saying that CIS is not able to process these many applications. I would be more than happy if some body in our forum posts, the "visa numbers calculations" we have done in this thread, into to his website.
Theres no doubt in the EB2 India/China will catch up current very soon. This is inevitable. There might be a mild retrogression for a very short span of time in the next few bulletins. But after that the dates will run like catching up the Current.

I partly agree with you. But Employer petition is not the right answer to points based system. A fair way would be to keep employer based system of H1B (with portability) as an entry point in the country and criteria to stay. But allow self petition after say X years (4 maybe) of continuous employment at wages higher than prevailing wages and in your area of expertise. In that case Labor cert can also be eliminated because if you have continuous employment for 4 years, the business definitely needs you.
So the process can be:
May 2006: Come here on H1B
May 2006 - May 2010: Work at wages greater than prevailing wage may be 10% higher
June 2010 - Submit your W2s, paystubs, Tax returns, Application for Green card
July 2010 - Get green card and enjoy :)

If you want to use AC21 and your current employer is playing dirty tricks like withholding you pay without any legal reason or trying to arm twist you into staying with him please try this following you would win without fail.
1) Try to negotiate with your employer and make sure you don't compromise on your paid leave balance, last few paychecks and experience letter.
2) If he is trying to scam you out of as much money as possible before you leave try to preserver all the written communication you had with him to recover your money.
3) With all that paper work you have enough ammo to get all the money back and shut your bloodsucking employer.
4) Call the sucker and tell him that you are sending a letter to the USCIS with CC to the president, congressman of your district and your state senator regarding your problem. Add in a couple of news agency names on the CC list just for kicks
You can never go wrong with this plan, you will get your money back within a few days.
BTW you can request USCIS to expedite your I485 and quote these kind of employer exploitation as a hardship. ( I never tried this part, who knows you might get your GC ahead of others) I don't know of anyone who has used this successfuly, if you try it please share your experience.

One basic note that Amway/Quixstar guys/preachers/creatures should understand is that "Not every business/job is for every one".
Few individuals can do only certain kinds of jobs. However, I notice that these Amway/Quixtar guys always project that, any dumbo can do this business (if followed rules). And also, they project that this is the only way earn money on this planet. If some one follows their own path (own ambitions), then they think that he/she is an idiot that they not joining them. For God's sake, Amway guys don't bug people. When some one said no means, Its NO. don't put pressure on strangers.
I will tell you my experience/observations with most of the Amway/Quixtar guys that I met.
1. They dream of early retirement, free money, free cruise trip, free vacations etc., where as in reality, they don't even buy good TV for them selves. I know few folks who purchased a 18 inches bathroom tv for $5.00. I am not against second hand a TV for less, but check the reality and see the difference between dreams and reality.
2. Forget about TV, it may not be an essential in life for everyone. I also noticed that they don't even purchase proper food/groceries. May be not are alike. I have see many in my past 15 years of life in US either in Bayarea or in Texas or in PA.
3. There was a Quixtar/Amway Summer conference few of years ago. I have seen 32 adult people stayed in a Single bedroom apartment (around 700 Sq Ft) for two nights. Yes, I literally counted people coming out of the door (right opposite to my apartment). I couldn't believe my eyes/brain initially but its truth.
I am not offending any one intentionally, but know the difference between reality and dreams.
These ppl just hang out at Walamart, Ikea, Malls and DMV and scour for desi ppl who are vulnerable and can be conned. The Amway guy I talked to spoke about retiring at 40 and making millions but was renting at 36 yrs himself and had a dingy old car. (I rent too but I don't plan to retire at 40 and make millions by conning ppl)

The point of the thread is that many people now think that cost of american dream is greater than the opportunity, and the balance is tilting in favor of other countries. Everyone makes their own assessment. No point in getting personal about it. Just a suggestion..using phrases like "suck blood out your body" will just reduce the effect of your argument.
And Do you (canadian wanna be) have any clue that to get respected salary and position you will be forced by illiterate Canadians to have "Professional Engineering Certificates"... It will suck blood out of your body for 5 years... So just do not read "Greener Side" of Canadian Immigration... I know it may not be applicable to all but more or less most of will have to face the same music in their careers. My all Canadian friends and relatives want to be Americans.. Only some of them practically could proceed for that.. After some stage of life it becomes hard to move families.. That is the reason they are facing now to take decision and simultaneously do not want to live in Canada anymore.. If you have 101 fever it will take 1 month to have Doctor's appointment... GST.. Higher taxes.. statistically there are chances "Most of members of this forum - Canadian Wanna Be" will have less promotions and/or increments in salary eventhough they will find themselves most skilled wherever they will work. Top posts would be the dream for most of you guys unless you start your own business.. if you understand what I am trying to tell... In USA it is not that way.... Having said this I can not say that everybody will experience the same what I am trying to portray but most fo them will.

Every time I hear "Canadian taxes are so much higher", I respond back with "really ? how much are you paying a month for health insurance?". I suggest a typical breadwinner with spouse + 2 dependents is probably paying $500 / mo + in health insurance premiums. Add that $6K / yr to your US tax bill, then compare it to your Canadian tax bill. ;)

well, the people who are in eb3 and cannot do anything about it, for reasons that you quoted, i agree, it is a pity. but, you know what, "life is not fair".
Yes life is not fair but when we get a chance to be fair we (And that includes me also) let it go by.
it is a good thing u worry about others, and want to help them. however, when u look at those bills you mentioned and none getting passed. yes, it may look like a waste to do anything. however, we need to keep trying. with the limited resources we have, i think we should focus on "things/bills/issues" the IMPACT most people. doing something only for eb3 or eb2, in my opinion, would be even more difficult, given the progress legal immigration has made in this country. so, may be, u cud help in getting the things done that impact more people.
What i porposed was doing something in the DV bill for badly retrogressed applicants (There wil be no reference to EB3 or EB2). Now the fact that this might help EB3 is because EB3 is the most badly retrogressed section.
and it is ur decision not to go eb2 (even, with the resources you mentioned). have to admit, thats strange. may be u r like me, who is not obsessed with a gc. however, we live in a society, in a system (however flawed it may be), and we all try to live by those rules, try to use opportunities that are available legally and make our lives, a little better.
You know what i was tempted to do EB2 but my sense of right and wrong prevented me. My mess up the already loaded and unstable system with another app when i already have one. Now for persons who are in EB3 (Please remove me from the equation) are thier not because they wanted to but because of the way thei whole immigration crap has evolved. Sure porting will help me out and i wil not need to justify this to anyone else but i will have to face myself. I know most people do not get it. It is doing right.
i came to this country in 1999, i have a MS, PHD from a reputed Comp Sci program. Many people who (still) dont know much about Computer Sci. came into the dept, got their MS and have been very successful, making tons of money. i am a guy whose bs, ms and phd is in Comp Sci. i think u will find may 2 or 3 guz out of may 10, who have a degree in CS, particularly in the undergrad. i used to be very mad at all the electrical, mechanical etc guz getting software jobs. i used to hate almost all software professionals coz i thought i had to work very had for my ranks, on my gpa and on my degrees and see there are people who are making as much as i do, with none of that. slowly, but surely, i have come to terms that "life is not fair" and then, what if fellow human beings can get good jobs, whats wrong with that?? is how i started to see it, (as long as they are good enough).

Please let me correct you EB3 is not a minority but a Majority in the EB community. just because a situation is not worth helping is not any reason to not step forward. I personally feel that IV can do something which will help EB3 because that i sthe only category which has no help from anyone. As for EB2 i have no grudges against them . You got your GC or will get it soon and all the best of luck to you, but if something can be done for EB3 it should be

well, it is noble to do what is "right" and to always stand for it. but, i dont believe for a second porting is "wrong". u wouldn't agree though but u dont have problems when others port. i have no argument about that.
people r in eb3, not becoz they want to. sure, i agree, given a choice, everyone will pick eb1. however, the question is, why have they been put there?? nobody forced them to. u dont qualify for other categories, u deal with it. (there may a few exceptions to that). so, i wud not feel really bad for people who had to be in eb3 (cud be lack of need qualifications or any other reasons, even things out of their control). as i said "life is not fair".
i think it is global, aren't there ROW eb3 people who are retrogressed as well. now, u may have a point in saying that eb3 is the majority. isn't that the case anywhere. take a look at the train (first class- few people, second class - more, general -- a lot). pls dont take this example as derogatory, becoz i dont mean it that way. my intention is usually the most generic category (that which may apply to most people) is most crowded. so, doing something wud probably impact a whole number of people--which means yes, anything possible that somebody can, should and must do.
however, that and being ahead in time, cannot be used as the only reasons to bypass eb2 and service or even share with eb3 (i think this was something proposed by some eb3 folks on this forum), i wud not agree. there were some other suggestions too, that i thought was not right. and i have already talked to you about my logic as to why.
i just thought working towards something that applies to "ALL" would be the way to go. But, I can kind of see your point too. Best of luck in whatever you do.

I completely agree with you that we should never forget our roots or our motherland. India is far better than US when it comes to family values and many other things. So who cares if he is SRK or anyone for that matter. When Colin Powell was the chief of security under Bush administration he had to go through airport security just like any other common person. The TSA here in US treats everyone the same. Do you think ministers or celebrities in India follow any security procedures ? Every now and then you hear of ministers and celebrities involved in smuggling scandals.
There are good and bad things about every nation. IMHO, security procedures in US are the far better than India and apply the same way to everyone unlike in India. I cannot believe there are 9 pages (and counting) worth of sentiments, because some lame talentless guy was subject to security checks at an International Airport. I'm someone who was born India, but never lived there - however I'd think there are incredibly talented Indians here in America and worldwide compared to someone who's used to blatant exploitation / sell out of Indian culture. You do not need to 'stand-up' for Shahruk Khan. Stand up for yourself, for every - everyday Indian Joe & Jane who've travelled from their hometowns to make a living and for a future. Stand up for the hero in you - not clownish make believe bollywood heroes.

What ever gave you the idea that EB ROW only wait for 3 years? There's this common misconception flying around here that somehow ROW just cruises by and we get GC handed to us on a platter when in fact up until yesterday EB-3 ROW was just as retrogressed as any other category not to mention that labor (pre PERM) and name check delays affected ROW just as much as everyone else. For instance, my brother, who is EB3-ROW with a PD of Dec 2002... and has been in the US since early 2000 and is still waiting in line...so do the math.
We're all in this crap together, some worse than others... so let's stop with this ROW Vs India & China nonsense. Country quotas are unfair and frankly the entire GC process is unfair and unpredictable... We should aim for solutions that solve this issue in a comprehensive way, not by dividing us even further.

It is important to know the numbers of traditional labors filed in year 2005 before PERM was implemented on March 28, 2005. Does anybody have hard numbers on these ?

Apparently this guy has and aganda and is purposefully twisting the fact to facilite his own benefits. With the consulate interview list out, it's absurb to suggest CP can in anyway use even "moderate" number of visa numbers. Also, considering the fact that uscis must approve 140k EB applications each year, it is obvious they must have the capability to process at least 10k each month, or , 20k for two months. There is absolutely no reason why uscis can not use at least 20k visa numbers in the following 2 months from AOS cases.
This Ron Gotcher guy does not seem to get it.... he has an agenda, I dont buy his logic. It is unlikely that ~ 50 cases at consular posts are enough motivation to move dates forward by two years.
It took roughly one year for EB2-I dates to advance beyond April04 from the time it first got to April 04.
We know 2005 is a lean year.
It is likely that it will take almost a year before EB2-I dates advance beyond June06.
