if you have your I-140 approved then you should be ok, provided your earned more than the prevailing wage for that year.
Even if you have I-140 approved, if the salary at the time you filed I-485 was less than the prevailing wage, they will examine again the company's ability to pay.
My I-140 was approved in 2006 and back then my salary was enough to prove the company's ability to pay. However, I got a NOID in my I-485 and the officer is asking to prove ability to pay again.

Everything is in flux right now and even the bill is approved, It takes some time for the new system to get in place and you can preserve the Priority Date of the LC applied under the old system, if you need to reapply as per the new merit based point system.

What exactly is the deal with the 2 I-94s? We get one with the H1-approval and one when we enter/re-enter the country. Now when we leave the country they automatically take then I-94 attached to the passport. What happens to the I-94 with the H1B approval. Are we supposed to give that away as well? I have left and entered the country 2-3 times but never surrendered the I-94 attached to the h1B.
Can someone please let us know how this I-94 surrendering and numbering works?
In the event you have a new 797 (with a new I94 attached to it), you are expected to staple that to your passport. You'd note that the new 94 WILL have the same number as the old one in the passport (if you've not travelled out of US in the interim period).
In this case I usually take out the old I94s and staple the new one in that place. Don't know if that's right or wrong, but I haven't had an issue until now.

I am little scared, I have taken an Infopass appointment for this friday at my local office, as my PD is current for EB2 - May, and still didn't get any status update or GCs.
Is it risky or inviting a risk by taking infopass apt. ?
Do you think I should have waited ?

I am thinking of traveling by qatar airlines. I believe they dont have any transit visa requirement.
It's not your airline but your transit stop. If your flight is through London, you'll probably need a transit visa, but check with someone.

As Far I as know we cannot have 2 Visas at the same time. The logic behind this is, L1 Visa is specifically meant for Company Transfer and you need to be having at least 1 year in the Company even before applying for L1 Visa.
And coming to having H1 simultaneously is not possible as you will be doing a transfer from H1 to L1 as you are still in the country and your H1 visa becomes invalid. Also the 6 year limit applies to both the period spent on H1 and L1.
If you would require to start afresh , then you need to go back the country and get fresh L1 visa stamped and that would be valid for 6 years...
I was in the same situtation and had to transfer from L1 to H1 as I did not want to go through the Visa appointment hassles.

This sustain act is total BS. They want to increase H1-B numbers without reforming the EB system. They do not want to increase EB numbers. They do not want to do away with country quotas. They don't have country quotas in H1-B. This just creates more and more backlogs for everyone. I HOPE THIS BILL DOESN'T PASS. The companies and lawmakers just want cheap labor without "paying" for it. Just a bunch of self-serving bigots !

The reality is there will not be another immigration bill this year if CIR does not make it. And calling CIR the "amnesty bill" means some of us may have started pandering to and unfortunately have fallen for the anti-immigrationists propaganda trap. That is fine if one thinks its okay to wait for another two years while a new congress settles in and for key immigration bills to come to the floor. However "cutting and running" is what we do when out of fear of association we fail to stand up and speak up and explain our motivating cause which is the plight of legal law abiding immigrants who contribute legally to this country. In my own personal opinion this is an excellent opportunity that can put IV in the spot light and distinguish IV for standing up for highly skilled immigrants. This requires good orational and communication skills so that one is not misquoted. If it takes wearing a t-shirt saying "Support Legal Immigrants" then so be it, but lets not cut and run on the basis of someone elses propaganda. If IV opts out then let it be because we could not find someone who could clearly get our unique message and goals out. Thanks to randallemery for bringing this opportunity to IV's attention and I hope the IV core will respond appropriately as this needs to be a well coordinated effort. When people fully understand the humanitarian reasons why legal immigrants need relief through CIR they tend to be more compassionate and supportive. However if we sit and twiddle our thumbs because of what Lou Dobbs says then we are doing exactly what these anti-immigrationists want us to do. The primary victory of Rep Chris Cannon (R) in Utah ought to be a shot in the arm for those fighting for CIR. Can anyone point me to the correct memo where Premium filing was made available for I-539 applications?
I searched all Mathew-Oh updates dated one year ago and can't locate it.
I need to get that h4 under premium ASAP so that I can transfer to H1 in April.
Can anyone please help?

I got in the habit of reformatting cards after a few episodes of returning a card with pix remaining to a different body and having it reset my numbering system. It's not uncommon to download cards from more than one body at a time. It's easier for me to format than to keep track of which card(s) came from which body.
I use (in order) a blower, an arctic butterfly, a lens pen. I check before going to the next step and try to get the job done with the least intrusion.
